Manila Seminars Successful!
We would like to thank everyone who attended the recent healthcare events in Pasig City and Naga City. We were quite impressed that there are a lot of you who have passed the NCLEX, not surprisingly because you have a great educational system in the Philippines. Of course, the fact that the NCSBN is offering NCLEX in Manila now does not hurt either. We hope that we were able to impart useful knowledge to you and answer your questions satisfactorily. August 2009 Visa Bulletin
The State Department has released the May 2009 Visa Bulletin. It states that visa numbers for EB3 category (where Schedule A visas for nurses and physical therapists are temporarily classified) are unavailable. This is due to the fact that the demand for adjustment of status cases has surpassed the available visas for this fiscal year. The Visa Bulletin also states that visa availabilities will resume in October, which is the start of fiscal year 2010. During our recent visit to the Philippines, we said that the issue of retrogression is not a matter of date, but rather of visa numbers. While on the surface it looked like there was a six-year waiting period last month (the visas having been retrogressed to 2003), it was not the real picture. Any bill that creates new visas or recaptures unused visas from previous years has the potential of ending the retrogression immediately if signed into law. The last such law that was passed created 50,000 visas, which lifted the retrogression right away. Another way of looking at it is this- the USCIS does not take 6 or so years to process a petition. It can finish it within a few months if the visas are available. So, again, the issue is the availability of visa numbers. At this time, MedCentric is monitoring some pending bills in Congress, any one of which may benefit our applicants when signed into law. The nurse shortage in the US will go on for many years and the government has no choice but to release those much-needed visas. What does this new development mean to you as applicants? The simple answer is this: it means that there are a lot of petitions being filed every month so the “queue” is getting longer. The current status of visa numbers does not change the petition process. Thus, the only wise thing to do is keep working on your sponsorship requirements and then file the petition as soon as you are ready.
